Client was arrested and charged with Sexual Assault. He was accused of having sex with a lady that told the investigator she was so intoxicated that she could not have given consent and did not remember anything that was said during the incident. After exhaustive investigation including discussions with various witnesses, it was found that the lady was not being totally truthful regarding the event. After putting a packet of information together with a short letter explaining what happened and giving this to the grand jury they decided not to indict him. Sometime in the future he will be able to erase all information associated with this nightmare from the record. Note that if he had been convicted or even put on deferred adjudication for this offense he could have been looking from 2 to 20 years in the penitentiary and would have to register as a sex offender for the rest of his life.
