Continuous Family Violence Dismissal
Individual arrested in a local county and charged with Continuous Family Violence, a third degree felony which carries from 2 to 10 years in the penitentiary. After research and talking to witnesses including the victim, it was determined it was mutual combat situations with our client coming out on the worse end. After several discussions with the victim, who lived in another state, she sent the District Attorney's office an affidavit of non-prosecution explaining what happened and that she does not wish to pursue the case further and would not want to appear if the case went to trial. The prosecutor subsequently dismissed the case. The case can now be expunged if the client wishes. The case now shows as a dismissal on his record.
