Do I need to appear in court?
This office has done many nondisclosures and expunctions and vast majority of the time the client did not have to appear in court.
We appear for you and discuss the case with the judge and almost always the Judge signs the order. If the request for the petition is contested by the District or County attorney, you may have to appear to answer some questions by the judge, the prosecutor, and your attorney. The purpose of the hearing would be to convince the judge that it is in the best interest of justice to grant the request if it is for a nondisclosure order or that all the statutory requirements are met if for an expunction.
